Landlord rules in Wales

Wales does not have tenancies; it has occupation contracts under the Renting Homes (Wales) Act 2016, a written statement due within 14 days, and Rent Smart Wales registration and licensing on top. These are the rules Rentura applies to a property in Wales.

The tenancy itself

Occupation contract types

Private landlords let under standard occupation contracts, which may be periodic or fixed term. Secure contracts are used by community landlords, not private landlords.

Periodic: rolls over from one rental period to the next (e.g. from week to week or month to month) without an end date, continuing until either party terminates it.

Written statement contents

The written statement must set out the names of the parties, the key matters, the fundamental terms, the supplementary terms, any additional terms, and prescribed explanatory information.

A written statement of an occupation contract must set out the names of the parties to the contract... the terms of the contract addressing key matters... the fundamental terms... the supplementary terms... and any additional terms.

Registration and licensing

Rent Smart Wales registration

every 5 years

Every landlord of a privately rented domestic property in Wales must register with Rent Smart Wales, whether or not they self-manage. Registration lasts 5 years. Letting or advertising an unregistered dwelling is a criminal offence.

The landlord of a dwelling subject to, or marketed or offered for let under, a domestic tenancy must be registered under this Part in respect of the dwelling.

Rent Smart Wales licensing

every 5 years

A landlord who carries out letting or management work themselves must also hold a Rent Smart Wales licence, valid 5 years. A landlord using a licensed agent for all such work needs registration only.

Once granted a licence is valid for 5 years.

Right to Rent does not apply in Wales

Not established from a Welsh official source. Right to Rent immigration checks were commenced in England only and appear never to have been extended to Wales.

Certificates and checks

Gas safety check

every 1 year

Every gas appliance and flue the landlord provides must be checked by a Gas Safe registered engineer within 12 months of installation and annually thereafter.

Electrical Installation Condition Report

every 5 years

There must be a valid electrical condition report at all times during occupation, obtained at least every 5 years. Non-compliance makes the dwelling unfit for human habitation.

The landlord must ensure that there is a valid electrical condition report in respect of the dwelling during each period of occupation... until the end of the period of 5 years beginning with the day on which the electrical safety inspection is carried out.

Energy Performance Certificate

every 10 years

A rental property must have a valid EPC rated E or above; an EPC is valid for 10 years from assessment.

Smoke alarms

On each storey there must be a smoke alarm in working order, connected to the electrical supply, and linked to every other mains-connected smoke alarm in the dwelling.

Carbon monoxide alarms

A working carbon monoxide alarm is required in every room containing a gas, oil-fired or solid fuel burning combustion appliance.

a carbon monoxide alarm which is in repair and proper working order is in each room of the dwelling which contains a gas appliance, an oil-fired combustion appliance or a solid fuel burning combustion appliance.

Deadlines

Deadline to give the written statement

14 days

The landlord must give the contract-holder a written statement of the occupation contract within 14 days of the occupation date.

The landlord under an occupation contract must give the contract-holder a written statement of the contract before the end of the period of 14 days starting with the occupation date.

Penalty for a late written statement

2 months

A landlord who misses the deadline must pay the contract-holder compensation equal to a day's rent for each day of default, until the statement is given or the end of a 2-month period, whichever is earlier. A court may increase it by up to 100% if the failure appears deliberate.

Electrical condition report: copy to the contract-holder

14 days

A copy of the electrical condition report must be given to the contract-holder within 14 days of the start of occupation or of the inspection.

The landlord must ensure that there is a valid electrical condition report in respect of the dwelling during each period of occupation... until the end of the period of 5 years beginning with the day on which the electrical safety inspection is carried out.

Deposit protection and prescribed information

30 days

A deposit must be protected in an authorised scheme, and the prescribed information given to the contract-holder, within 30 days of receiving it.

Rent

Rent increase on a periodic standard contract

2 months

A landlord may increase rent by notice specifying a date at least 2 months ahead. After the first increase, each later increase must take effect at least 12 months after the last one did.

The period between the day on which the notice is given to the contract-holder and the specified date may not be less than two months

Ending a tenancy

Landlord's no-fault notice, s.173

6 months

On a periodic standard contract a landlord may end the contract without a reason by serving a s.173 notice, form RHW16, specifying a date at least 6 months ahead. The notice cannot be served until 6 months after the occupation date.

The date specified in a notice under section 173 may not be less than six months after the day on which the notice is given to the contract-holder.

Serious rent arrears

14 days

Possession on serious rent arrears requires at least 8 weeks' unpaid rent for weekly, fortnightly or four-weekly periods, or 2 months' for monthly periods. The landlord gives a possession notice, form RHW20, and cannot claim until 14 days later.

The landlord may not make the claim - (a) before the end of the period of 14 days starting with the day [notice is given].

Breach of contract notice

1 months

For a breach other than rent arrears the landlord gives a possession notice, form RHW23, and must wait 1 month before claiming. Any possession claim must be made within 6 months of the notice or a fresh notice is needed.

The landlord may not make a possession claim in reliance on a breach of any other term of the contract before the end of the period of one month starting with the day on which the landlord gives the contract-holder a possession notice.

Form and service of notices

Notices under the Act must be in writing and may, subject to conditions, be given electronically. Welsh Ministers prescribe the form of particular notices.
