The pre-action record should show actual engagement. Keep the information supplied, proposals considered and reasons for the next step.
Give information the tenant can use
- Provide the tenancy's rent terms and a clear breakdown of arrears with due dates.
- Explain the ending process and steps intended to avoid eviction.
- Include sources of independent advice and use a communication format the tenant can understand.
Work towards payment
- Discuss current rent and arrears together, considering the tenant's income and proposals.
- Explore relevant benefit or support issues without promising eligibility.
- Confirm any agreement in writing and keep it under review.
Consider the response
- Record payments, reasons for a missed instalment and any proposed alternative.
- Consider changes in circumstances and steps the tenant is taking.
- If proceeding, give the adviser or tribunal the complete history rather than only the final unpaid balance.
Example: the tenant asks for a review after a benefit decision
A fictional tenant expects a benefits decision shortly and offers an interim payment. Consider the evidence and proposal and record the reasoned response. Ignoring it would leave a gap in the pre-action history.
What to do
- Give the required rent, arrears, ending-process and advice information.
- Make reasonable efforts to agree an affordable plan.
- Review circumstances and responses before applying for eviction.
Evidence to keep
- Information pack and delivery evidence.
- Payment proposals, responses, support information and review notes.
