Respond when a tenant withholds rent because of repairs

Investigate the repair, identify any disputed rent liability and manage the account without using the repair as pressure.

England · Wales · Scotland · Current guidance

Checked 20 October 2026. Review due 19 November 2026.

Run the repair response and the rent assessment together. A landlord should not stop necessary work because rent is unpaid, and should not assume every withheld amount is automatically justified.

Establish the condition

  • Ask for the location, nature and history of the defect and inspect with appropriate urgency.
  • Check earlier reports to an agent or contractor, not just the first message received personally.
  • Record interim safety arrangements and the plan to investigate or repair. Do not demand payment as a precondition for addressing a hazard.

Understand the dispute

  • Ask which rent periods and amounts are withheld and what remedy the tenant seeks.
  • Distinguish alleged unfitness, disrepair compensation, an agreed reduction and a tenant's own repair expenditure. They may involve different legal questions.
  • Mark the disputed amount clearly while retaining an accurate schedule of charges and receipts.

Choose a lawful next step

  • Obtain advice on rent liability, any counterclaim or set-off and the effect on possession thresholds.
  • Consider a documented resolution or payment arrangement without asking the tenant to waive rights through unclear wording.
  • Keep the repair case open until the work is verified, even if the rent dispute settles first.

Example: the boiler is repaired but the historic dispute remains

A fictional tenant resumes payment after a boiler repair but disputes rent during the earlier outage. Record the resumed payments and keep the historic dispute separate. A completed repair does not by itself decide the amount legally due for the earlier period.

What to do

  1. Assess the reported defect and arrange urgent action where needed.
  2. Identify exactly what rent is withheld and the reason given.
  3. Obtain country-specific advice before possession or recovery action.

Evidence to keep

  • Repair reports, inspections, access and completion records.
  • Rent statement, tenant explanation and any compensation or set-off claim.
