Scottish private-tenancy civil claims have specific tribunal procedures. The correct application depends on the tenancy type and remedy, so start with the Chamber's current forms and guidance.
Choose the correct application
- Identify whether the arrangement is a PRT, assured tenancy or another type.
- Check the current forms and rule for a payment claim. An eviction application is separate even when based on the same arrears.
- Confirm the correct legal applicant and respondent, including any issue involving an agent, company or guarantor.
Present the debt clearly
- Provide the rent terms and a schedule showing due dates, receipts and the balance.
- Include relevant correspondence, agreed credits and any disputed liability.
- Follow directions about documents, service and attendance, and obtain advice where the claim is contested.
After a decision
- Credit voluntary payments and any deposit recovery so the order is not enforced for money already received.
- Check time-to-pay arrangements and debt protections before enforcement.
- Use the lawful enforcement process through the appropriate professional; a payment order does not authorise seizure of property by the landlord.
Example: possession and money are both sought
A fictional landlord wants the tenant to leave and to pay £2,000 arrears. Check and prepare the distinct eviction and civil applications required for the tenancy. Do not assume that asking for eviction automatically produces a payment order.
What to do
- Identify the tenancy type and applicable civil-proceedings rule.
- Prepare the agreement, accurate schedule and required supporting documents.
- Keep the tribunal informed of payments and material changes.
Evidence to keep
- Tenancy, rent variations, receipts and final or current schedule.
- Application, service information, tribunal directions and order.
