Property advertising must include the EPC rating. Scottish rental standards and future energy policy should be checked separately from the MEES rules used for properties in England or Wales.
Find the correct Scottish EPC
Use the certificate for the actual dwelling and the Scottish process. Do not apply the English minimum E rule without checking Scottish law.
- Match the address, rating and date, particularly after conversion into flats or a change in heating.
- Give the required information to prospective tenants and include the EPC details required in advertisements.
- Record any exemption or unusual circumstance with its source and supporting evidence, rather than simply leaving the EPC field blank.
Assess proposed improvements
The EPC identifies possible measures, but the suitability and legal requirements of works need their own assessment.
- Review heating, insulation and ventilation together with competent advisers. Check building-warrant, planning and listed-building requirements where relevant.
- Compare costs, disruption and expected benefit using property-specific quotations. Do not promise a particular future rating before assessment.
- Coordinate work with the tenant, including access, temporary loss of services and completion checks.
Track actual law changes
Scottish energy proposals and consultations should be recorded separately from current duties.
- Check the official source for commencement, property scope and transition before applying a new minimum standard.
- Keep the version of the certificate, work specifications and any reassessment so the property's position can be explained.
- Review adverts and property records after a new certificate is issued, and remove an old rating that no longer applies.
Example: an English checklist is reused
A fictional agent asks a Scottish landlord to prove compliance with an English private-rental MEES rule. Ask for the applicable Scottish requirement and assess the property against that. Similar subject matter does not make the two regimes interchangeable.
